4. SMS/Text Messaging Terms 

4.1 Consent 
By providing your mobile phone number and opting in to our text messaging service, you consent to receive SMS messages from The Bright Haven Center as described in our Privacy Policy. 

4.2 Message Frequency and Charges 
Message frequency varies. Message and data rates may apply. You are responsible for any charges imposed by your mobile carrier. 

4.3 Opt-Out 
You may opt out at any time by: 

•      Texting STOP to any message

•      Updating your preferences in your account 

4.4 Service Availability 

We do not guarantee that text messages will be delivered to you in a timely manner or at all. We are not liable for delays or failures in message delivery caused by your mobile carrier, internet service provider, or other factors beyond our control. 

5. Donations and Financial Transactions 

5.1 Donation Policy 
All donations to The Bright Haven Center are voluntary and are used to support our mission and programs as described on our website. 

5.2 Tax Deductibility Donations to The Bright Haven Center are tax-deductible to the extent permitted by law. We will provide a receipt for your donation for tax purposes. 

5.3 Refund Policy 
Donations are generally non-refundable. However, if you believe an error has occurred or have concerns about a donation, please contact us at donorsupport@thebrighthavencenter.org within 14 days of the transaction.  

 5.4 Recurring Donations If you set up recurring donations: 
•      You authorize us to charge your payment method on the frequency you selected
•      You may cancel at any time by contacting us at donorsupport@thebrighthavencenter.org 
•     Cancellations will take effect in the next billing cycle 

5.5 Payment Processing We use third-party payment processors to handle financial transactions. By making a donation, you agree to the terms and conditions of our payment processor(s). 

6. Intellectual Property Rights 

6.1 Our Content The Service and its original content, features, and functionality are and will remain the exclusive property of The Bright Haven Center and its licensors. The Service is protected by copyright, trademark, and other laws. 

6.2 Trademarks Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of The Bright Haven Center. You may not use such marks without our prior written permission.
 
6.3 User-Generated Content If you submit, post, or upload content to our Service (such as testimonials, photos, or comments): 
•      You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for our       organizational purposes 
•      You represent that you own or have the necessary rights to the content 
•      You understand that we may remove any content at our discretion

•      Warranties of MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT 
•      That THE SERVICE WILL MEET YOUR REQUIREMENTS 
•      That THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE 
•      That THE INFORMATION PROVIDED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, OR CORRECT 

9. Limitation of Liability 
IN NO EVENT SHALL THE BRIGHT HAVEN CENTER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

12. Volunteer and Program Participation 

12.1 Assumption of Risk 
If you participate in our programs, volunteer activities, or events, you acknowledge that such activities may involve inherent risks and you voluntarily assume all such risks.  

 12.2 Release of Liability 
To the extent permitted by law, you release The Bright Haven Center from any and all liability for injuries or damages that may occur during participation in our programs or activities, except for injuries caused by our gross negligence or willful misconduct. 

12.3 Media Release 
By participating in our programs or events, you grant us permission to use photographs, videos, or other media featuring you for promotional and educational purposes, unless you notify us otherwise in writing. 

13. Modifications to Service and Terms 

13.1 Service Changes 
We reserve the right to withdraw or amend our Service, and any service or material we provide, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

 13.2 Terms Changes 
We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. 

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes. 

14. Governing Law and Jurisdiction 
These Terms shall be governed and construed in accordance with the laws of Florida, United States, without regard to its conflict of law provisions.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
